Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Mosena mobile application, website, and related services (together, the "Service"). The Service is operated by an individual sole developer ("Mosena", "we", "us"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Mosena is

Mosena is a personal reflection app. You converse with an AI in text or voice. The AI remembers what you say over time, summarises your conversations, and surfaces recurring patterns and themes. The goal is to help you notice things about yourself between sessions with your therapist or alongside your own reflective practice.

Mosena is informational and reflective in nature. It does not provide diagnosis, treatment, or therapy.

2. Who can use Mosena

• You must be at least 18 years old. Registration requires you to enter your year of birth and we reject sign-ups that do not meet this threshold. This is the operative age requirement regardless of any lower App Store age rating.
• You must be legally able to enter into a binding contract in your jurisdiction.
• You must not be barred from using the Service under applicable law.

If you create an account on behalf of another person, you confirm you have the authority to do so and that person meets the eligibility requirements.

3. Your account

• Provide accurate information when registering and keep it up to date.
• Keep your password confidential. You are responsible for activity under your account.
• Notify us promptly at magleb@mosena.app if you suspect unauthorized access.
• One person, one account. Sharing accounts is not allowed.
• You can delete your account at any time from inside the app (Profile → Delete account). Deletion is permanent.

4. Acceptable use

When using the Service, you agree not to:

• Submit content that violates the rights of others, including intellectual property and privacy rights.
• Impersonate another person or misrepresent your identity.
• Use the Service to harass, threaten, or harm others.
• Attempt to interfere with, disrupt, reverse-engineer, decompile, or circumvent the security of the Service.
• Use the Service to violate any applicable law or regulation.
• Use automated means (bots, scrapers) to access the Service without our written consent.
• Use the Service to train your own machine learning models on AI-generated content from Mosena.

5. Your content

Anything you write or record in Mosena ("Your Content") remains your content. You retain all rights you have in it.

You grant Mosena a limited, worldwide, royalty-free licence to host, process, and analyse Your Content solely to provide the Service to you — for example, to send it to our AI subprocessor for response generation, to store summaries in our database, and to display patterns back to you. This licence ends when you delete Your Content or your account, except for backups that are rotated within 90 days.

We do not use Your Content to train AI models, sell Your Content, or share Your Content publicly. See our Privacy Policy for details on how data is handled.

6. AI-generated content

Mosena's responses, summaries, pattern observations, and recommendations are generated by an AI model. AI can make mistakes, including:

• Misinterpreting what you said.
• Inventing facts or events that did not happen ("hallucinations").
• Providing reflections that do not apply to your actual situation.
• Missing important context or nuance.

Treat AI-generated content as one input among many. Verify any conclusion that matters with a qualified human professional. Do not make important medical, legal, financial, or relational decisions based solely on Mosena's output.

7. Not medical advice

Mosena is not a medical device, not a healthcare provider, and does not provide medical advice, diagnosis, or treatment. Information from Mosena is informational and reflective only.

Always consult a qualified mental health professional for diagnosis, treatment, or guidance on mental health conditions. Never disregard professional advice or delay seeking it because of something you read or heard in Mosena.

8. Crisis disclaimer

Mosena is not designed for crisis intervention. If you are experiencing thoughts of suicide, self-harm, or harm to others, or are in any other immediate danger, stop using the app and contact one of the following:

• Russia: 112 (general emergency), 8-800-2000-122 (Children's Helpline, also serves adults).
• USA: 988 (Suicide and Crisis Lifeline).
• UK: 116 123 (Samaritans).
• EU: 112 (general emergency).
• International directory: findahelpline.com.

9. Intellectual property

Mosena, including the app design, code, brand name, and logo, is owned by the Operator and protected by applicable intellectual property laws. You may use the Service only as permitted by these Terms. No rights are granted to you in our intellectual property except as expressly stated.

10. Paid features

The Service is currently provided free of charge during early access. We may introduce paid subscriptions or features in the future. If we do:

• We will give you advance notice of pricing and what is included.
• Existing free features available at the time of your account creation will remain free, except where a transition path is clearly communicated.
• Paid subscriptions will be billed through the App Store and subject to Apple's billing terms.
• You can cancel any subscription at any time through your App Store account settings.

11. Termination

You can stop using the Service at any time and delete your account in-app. Account deletion is permanent.

We may suspend or terminate your access if you breach these Terms, if your use creates risk for us or other users, or if we are required to do so by law. Where reasonable, we will notify you in advance.

12. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Service will be uninterrupted, error-free, secure against all attacks, or that AI-generated content will be correct or suitable for your needs.

13. Limitation of liability

To the maximum extent permitted by applicable law, the Operator's total aggregate liability arising out of or relating to these Terms or your use of the Service is limited to:

• The total amount you paid to Mosena in the 12 months preceding the event giving rise to the claim, or
• USD 100, whichever is greater.

In no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or psychological harm allegedly arising from the use of AI-generated content.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In such cases, the limitations above apply only to the maximum extent permitted by your local law. Nothing in these Terms limits liability for death, personal injury, fraud, or other liability that cannot be excluded by law.

14. Governing law and disputes

These Terms are governed by the laws of Georgia, without regard to its conflict-of-laws principles. Disputes arising out of or relating to these Terms or the Service will be submitted to the competent courts of Georgia, unless mandatory consumer protection laws in your jurisdiction grant you a different right.

If you are a consumer in the European Union, you retain all mandatory consumer protections granted by the law of your country of residence.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email at least 14 days before the changes take effect. If you continue using the Service after the changes take effect, you accept the revised Terms.
